By engaging Dauntless Grade for design, visualization, or engineering services, you agree to the following terms. Please read them carefully before submitting a project request.
1. Scope of Services
Dauntless Grade provides architectural design, 3D visualization, and structural engineering services as described in each project proposal. The specific deliverables, revision rounds, and timeline are defined in the signed proposal. Work outside the agreed scope will be quoted separately.
2. Pricing and Payment
All pricing is fixed per the signed proposal. We do not bill hourly for work within scope. Payment is required before project work commences. For larger packages, we may split into a deposit at kickoff and final payment upon delivery. Prices are subject to change for new projects but are locked upon proposal acceptance.
3. Revisions
Each package includes a defined number of revision rounds as specified in the proposal. Revisions within scope are included. Additional revision rounds beyond the agreed scope are billed at our current hourly rate. Major scope changes (additional floors, significant program shifts) are treated as new scope items and quoted separately.
4. Intellectual Property
Upon final payment, the client receives full ownership rights to the delivered drawings and renderings for their specified project. Dauntless Grade retains the right to use project images in our portfolio and marketing materials unless the client requests otherwise in writing prior to project start.
5. PE Stamp and Engineering Liability
Engineering services and PE stamps are provided by licensed Professional Engineers. The PE stamp certifies that the structural design meets applicable building codes at the time of delivery. The client is responsible for ensuring the correct jurisdiction is specified at project start. Engineering documents must not be altered after PE stamp is applied. Dauntless Grade is not liable for permit rejections due to site conditions, local amendments, or information not provided at project start.
6. Permit Outcomes
Dauntless Grade delivers permit-ready documentation to the best of our professional ability and experience. However, we cannot guarantee permit approval, as final decisions rest with local authorities having jurisdiction (AHJ). If plan check corrections are required for items within our original scope, we will address them at no additional charge within the agreed revision rounds.
7. Client Responsibilities
The client is responsible for providing accurate site information, jurisdiction details, and any existing surveys, soil reports, or utility documents. Information provided to Dauntless Grade is assumed accurate. Errors in client-provided information that require rework may result in additional charges.
8. Turnaround Times
Quoted turnaround times are estimates based on current workload and project complexity. Dauntless Grade will communicate proactively if a timeline changes. Delays caused by client feedback response time, scope changes, or third-party factors (jurisdiction reviews, etc.) are not included in our quoted turnaround.
9. Confidentiality
Dauntless Grade treats all client project information as confidential and will not share project details with third parties without client consent, except as required to perform services (e.g., licensed PE subcontractors under NDA).
10. Limitation of Liability
Dauntless Grade's total liability for any claim arising from services shall not exceed the total fees paid for the project in question. We are not liable for indirect, consequential, or incidental damages. This includes but is not limited to project delays, contractor errors based on our documents, or cost overruns.
11. Governing Law
These terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of Denver County, Colorado, unless otherwise agreed in writing.
12. Updates to Terms
These terms apply to new project engagements as of the date listed above. Existing projects are governed by the terms in effect at the time of project acceptance.
